Perlembagaan ‘Is Non-Negotiable’… PM Hilang Sokongan Majoriti
Rakyat Malaysia telah menyaksikan pelbagai parti politik dan ahli Parlimen tampil dengan kenyataan menolak kepimpinan Perdana Menteri.
Semua ini membolehkan kita merumuskan bahawa Perdana Menteri telah hilang sokongan majoriti di Parlimen.
Khabar bahawa Istana Negara telah menulis untuk mendapatkan pengesahan Speakar Dewan Rakyat tentang jumlah sokongan Ahli Parlimen terhadap Perdana Menteri jelas membuktikan bahawa Istana Negara sangat meragui dakwaan Perdana Menteri bahawa beliau masih mempunyai majoriti.
Tindakan ini adalah ‘unprecedented’ dan meletakkan kewibawaan Perdana Menteri pada tahap yang tidak boleh diyakini dalam tindakan dan kenyataannya.
Malah dakwaan masih mempunyai majoriti oleh Perdana Menteri adalah tindakan yang tidak berpelembagaan. Apatah lagi beliau sengaja menunda pengesahannya di Parlimen tanpa alasan yang wajar.
Nampaknya DYMM SPB Yang di Pertuan Agong sangat bersungguh-sungguh mempertahankan Perlembagaan Negara dengan bertindak mengikut lunas Perlembagaan.
Perdana Menteri pula jelas menggunakan Perlembagaan untuk kelangsungan hayat politiknya dan bukan untuk memelihara kewibawaan institusi Perdana Menteri.
Tindakan Perdana Menteri yang nyata hilang keabsahan dan kelayakan setelah hilang sokongan majoriti dan tidak bertindak segera meletakan jawatan akan menyebabkan pelbagai tindakan yang diputuskan oleh Kerajaan mempunyai risiko perundangan yang besar.
Semua keputusan Eksekutif tersebut boleh dicabar keabsahan dan keperlembagaannya. Ini meletakkan Kerajaan dalam kedudukan terdedah kepada pelbagai pertikaian undang-undang dan risiko kerugian kewangan.
Bagi mengelakkan negara terus berada dalam kancah kecelaruan Perlembagaan sebegini, wajarlah pihak Eksekutif tampil dan melakukan tindakan yang benar dan berpelembagaan.
Mereka harus memudahkan DYMM SPB Yang di Pertuan Agong melaksanakan tugas Perlembagaan baginda dan bukan bertindak sebaliknya.
Tiada yang lebih penting kepada seorang Perdana Menteri selain melaksanakan tanggungjawabnya selari dengan batas dan mandat yang diperuntukkan oleh Perlembagaan.
Perdana Menteri waktu ini nampaknya bersendirian mempertahankan kedudukan yang tidak boleh dipertahankan lagi. Beliau seharusnya tahu bahawa Perlembagaan ‘is non-negotiable’.

Malaysians have witnessed various political parties and Parliament members releasing statements rejecting the Prime Minister’s leadership.
All these allow us to conclude that the Prime Minister no longer has the majority support in Parliament.
The news that Istana Negara has written to the Dewan Rakyat Speaker to confirm on the number of Members of Parliament supporting the Prime Minister clearly proves that Istana Negara is very sceptical of the claims made by the Prime Minister that he still holds majority support.
This is an unprecedented turn of events and casts doubt upon the credibility of the Prime Minister’s statement and action.
The Prime Minister’s claim of still holding majority is unconstitutional, including his decision to deliberately postpone parliament sitting to confirm his support without any valid reasoning.
It seems that DYMM SPB Yang di-Pertuan Agong is very serious in upholding the National Constitution, acting within the boundaries set by the Constitution.
The Prime Minister, on the other hand, is using the Constitution for his political mileage instead of preserving the integrity of the Prime Minister’s institution.
The actions of the Prime Minister who has clearly lost his legitimacy after losing the support of the majority and does not step down immediately will cause the various actions decided by the Government to have significant legal repercussions.
The legitimacy and constitutionality of every decision made by the Executive can be challenged. This will put the Government in a difficult position, exposing them to a multitude of legal disputes and financial loss risks.
To prevent the nation from continuing to spiral down in the midst of this constitutional disarray, the Executive must come through and take the right action and uphold the Constitution.
They must ease and assist DYMM SPB Yang di-Pertuan Agong in carrying out his constitutional duty rather than complicating it.
Nothing is more important to a Prime Minister than fulfilling his responsibilities within the limits and mandate provided by the Constitution.
Currently, the Prime Minister seems to be the only one defending a position that can no longer be defended. He should know that the Constitution is non-negotiable.
